This Terms of Style Box Service is made between the website operator (“Company”) of https://www.rosegal.com/ and the software, materials, content, and services available therefrom and any updates, modifications, or enhancements thereto ( collectively, the “Rosegal”), and you (the “User”) who may access and use Rosegal and technology thereon, only following all Platform Agreement. The Terms Of Style Box Service is Rosegal Website's Supplementary Agreement to the Terms Of Users, so all terms and conditions are also subjected to the Terms Of Users. If you confirm to choose and Subscribe to the ROSEGAL Style Box, please read the below Terms Of Style Box Service carefully.

ACCOUNT

To ensure the normal development of the service, you must register a valid account in ROSEGAL before you use the service of ROSEGAL Style Box to provide us with your name, shipping address, postcode, and other information(“Shipping Information”). For your account security and shopping experience, you represent and warrant that (a) all required information submitted by you is true and accurate and that you will maintain the accuracy of such information, (b)please also keep your account information private. If someone uses your account information to access our services, we will rely on that account information and assume that you or someone you authorize is accessing the services. You are solely responsible for any use of your account information and all activities that occur under or in connection with your account, including orders placed through the Services. To make the service best for you, we will also ask you to provide additional information about yourself, including your size, fit, and fashion profile, please keep your fashion profile up to date.

SHIPMENTS

If you are a user of the ROSEGAL Style Box service, you can select the Style Box Plan through the service subscription page and request that we automatically send you products at a specified rhythm. At the same time, you authorize us to automatically charge you a Service Fee according to the billing cycle you selected.

After you subscribe to the ROSEGAL Style Box service, we will, at our discretion including without limited sizes, clothing types ect, send you some Products selected by ROSEGAL based on the information you submitted and subscribed content.

Available ship dates are determined at our discretion and may vary based on a variety of factors, including without limitation inventory, geography, and automatic shipping preference. You may also be able to select particular items to be included in your Fix. You will be able to try them on to see what you like. You can decide to keep all, some, or none of the Products in the shipment, and we will charge you for the items you keep as described in the SERVICE FEE AND PAYMENT section(below).

SERVICE FEE AND PAYMENT

Prior to shipping your Products every time, we may charge you a non-refundable Service and Products Fee in the amount set forth on the Services.The Service Fee will be charged to your credit card or another payment method between the time the order is placed.Within days of receiving your Styling Box,you can send back any Products you don’t want. If you choose to keep Products from your Style Box, Rosegal may charge you for the Products according to the terms of service and your subscription.You may pay for any Products or Subscriptions via credit card or another payment method then available on the Services. If you have a credit in your Account at the time of paying for Products or Subscriptions, the credit will be applied before we charge your credit card or other payment methods then available. By submitting your payment information to us, you authorize us to charge your credit card or other payment methods then available by these Terms.

You represent that you will not use any credit card or other form of payment unless you have all necessary authorization to do so. We will not be liable in the event your children or others acting with or without your permission use your credit card, PayPal account, or other means of payment to make orders on the Services; however, you may report any unauthorized use to us, and we will use reasonable measures within our control to help prevent future unauthorized use of your credit card or other payment methods. While Style Box makes efforts to follow the style and price preferences you express in “Note to my stylist”, we do not guarantee that every item in your Style Box will meet those preferences. You are responsible for paying for all Products in your Style Box, whether they conform to your requirements or not unless you return the Products by our policies.Meanwhile you are responsible for the payment of any Products or Services, and state and local sales taxes that apply to your order.

RETURNS AND EXCHANGES

Sending Back Products During the Try-On Period. If you want to return or exchange any of the Products in your Subscription, simply inquire about our returns and exchanges method at“Contact Us”,you will retain title to the Products and the risk of loss of the Products will remain with you until we receive the Products and we determine that the Products were returned unworn and in their original condition, at which point you will be deemed to have rejected the Products and title to Products will return to us.We will assume that you have chosen to keep any Products in the Subscription and charge your Account for those Products until you postmark them back to us by the end of the Try-On Period. Any exceptions permitting a return postmarked later than the end of the Try-On Period must be requested promptly and may be granted at the sole discretion of Rosegal.

If you want to exchange any of the Products you received in the Style Box you subscribe to (e.g., for a different size), you can request an exchange by accessing “Contact us” and by the "Return&Exchange" flow to meet your requirements. If an exchange is available for a particular Product, you will be given the choice to exchange. Unfortunately, because of some objective factors including without limitation, inventory, or geography, we cannot guarantee that you will be able to exchange or replace any item you want. If you elect to receive an exchange, return the original Product in the prepaid return package by the end of the Try-On Period. The exchanged Product will be sent separately to you.

If you fail to return the original Product by the end of the Try-On Period or if the original Products is damaged or shows signs of wear, Rosegal may charge you for the Products. If you receive the exchange Products and wish to return it, you can send it back within 7 days of your receipt.

UNSUBSCRIRTION

If you select and subscribe to Style Box Service, you agree that we may charge the Service Fee of Subscription Price to the card or other payment method on file repeatedly according to the frequency you selected until you cancel your subscription by clicking the “Unsubscription” link on the Subscription homepage.If you want to stop accepting the Style Box Service, you should cancel your subscription to Style Box Service at any time before the Products are due to ship, otherwise, Rosegal will charge for having shipped products.After you receive these Products, you can base on the above RETURNS AND EXCHANGES to return the Products you received,and Rosegal will return Products Fee/Service Fee.

LEGAL DETAILS

All Products will be deemed accepted by you upon shipment, and title to and risk of loss passes to you when we provide the Products to a common carrier. Excluding any User Content, we strive to ensure that the information on the Services is complete and reliable. Certain information may contain pricing errors, typographical errors and other errors or inaccuracies, which we may correct without liability. Products displayed may be out of stock or discontinued, and prices are subject to change. We reserve the right to limit quantities purchased by Clients. We do not guarantee that all Products described on our Services will be available. In an effort to enhance your shopping experience and give as many customers as possible the opportunity to purchase Products, we may place limits on purchases and we do not authorize the purchase of commercial quantities of our Products. We further reserve the right to cease doing business with customers who violate this policy.

LIMITATION OF LIABILITY

If you are dissatisfied with any portion of the Services, your sole and exclusive remedy is to discontinue use of the Services. Our total liability to you for all claims arising from or related to the Services is limited, in aggregate, to the greater of (i) the total amount of your orders in the six (6) months prior to the date of the event giving rise to our liability, or (ii) one hundred dollars (U.S. $100.00).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations and disclaimers may not apply to you. To the extent that we may not, as a matter of applicable law, disclaim any implied warranty or limit liabilities, the scope and duration of such warranty and the extent of our liability will be the minimum permitted under such applicable law.

Without limiting the foregoing, under no circumstances will we or our licensors be held liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond our reasonable control, including without limitation internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, or non-performance of third parties.
